Legal Separation & Separate Maintenance
Temporary separation (legal separation) in Utah–
Temporary separation allows the parties an option other than divorce. The court will enter orders to establish temporary provisions concerning alimony, property and debt management and division, health care insurance, housing, child support, child custody and parent time.
Both parties must be residents of the state for at least 90 days prior to the date of filing and the order will not be valid longer than 1 year. Both parties must attend the divorce orientation course.
Separate Maintenance in Utah–
Separate maintenance allows married couples to legally separate their affairs for longer than 1 year without obtaining a divorce, but only under limited circumstances. A separate maintenance order governs health insurance, child custody, child support, parent time, alimony, and property and debt division. The court proceedings in separate maintenance are the same as for divorce.
